Foster v. Kroger Dedicated Logistics Company and Tullos
In this case, the plaintiff Mr. Foster was driving in a construction zone on the interstate. A vehicle in front of the Plaintiff slammed on his brakes. Mr. Foster was able to get to a complete stop but the 18 wheeler owned by Kroger behind Mr. Foster and driven by Tullos was unable to stop. Kroger initially denied liability. Suit was filed and this firm was able to establish in discovery several violations by the driver. Mr. Foster suffered an injury to his neck which resulted in a fusion at two levels.
